The practice of allowing access to your own electronic medical record, as well as the record of family members, is no longer permitted at Marshall Health. In the past, staff may have produced a release of information authorization giving permission to access their own medical record or the medical record of a family member or friend. These authorizations are no longer valid and cannot be renewed. Any access to personal medical records should be through the HealtheLife patient portal or by submitting a release of information authorization to the Health Information Management department.
Under the HIPAA Privacy Rule, all covered entities and their employees are required, by law, to abide by the Minimum Necessary Standard Rule. This rule only allows you to access PHI for patients that you are actively participating in their care and treatment. This prohibits you from accessing your own records, as you will never be involved in your own care and treatment. This standard also applies to the medical and billing records of family and friends unless you are accessing the record as part of their care team.
This change applies to all workforce members including staff, faculty, residents, fellows, and medical students.
